san jose police say they've caught the serial arsonist. the details we're learning about the suspect's criminal history. marin county officials taking emergency action today as water concerns grow in a state-wide declaration, it appears imminent. several people arrested for the southern california wildfire burring out of control. how many homes have burned and how many people have evacuated.

he's accused of setting at least a dozen fires throughout san jose and forcing residents to set up their own neighborhood patrols to protect their homes. as we first broke the news to you last night on the 10:00 news, police say the suspected arsonist is behind bars. good afternoon, i'm tori campbell. janine de la vega is live in front of the police department where we learned more about the suspect's background and how the arrest took plate. >> reporter: police say they are certain this suspect acted alone. they served a search warrant on his home and say he lived alone and when they got to the house, they say they found fight a bit of evidence linking him to the fires. police say 48-year-old patrick william brennan is the man who has been trerrizing his -- terrorizing his neighbors. around 8:00 last night he was arrested. they described his behavior as

forthcoming. >> he was not agitated and very cooperative with investigators. >> reporter: sometime between saturday evening and sunday morning, scar a sergeant -- a sergeant patrolling the evening spotted the person of interest. officers were conducting surveillance on brennan. they say what pieced together was the surveillance camera. they say the video was crucial in identifying brennan and realizing he was a suspect in past arsons locally and out of state. >> the tipping point was the work of one hard-working night sergeant who took it upon himself to conduct investigative leads using databases that we have to come up with a person of interest that had some priors of arson whoive willed in the area. >> reporter: the -- who lived in the area. >> reporter: the string happened bhorlt of downtown. 13 in all. authorities believe he's responsible for 12 which includes the massive five-alarm fire which destroyed a commercial warehouse, fires caused damage to several homes

and a church. residents are grateful brennan is behind bars. >> i've been feeling terrible -- i mean terrified about the whole thing. but now that he's caught, i think the whole neighborhood is really relieved. i slept very well last night. >> reporter: we have learned that brennan is listed as a registered sex offender on california's megan law's website. at this point, police say they don't have a motive for the arsons. they wouldn't reveal whether or not brennan confessed or not. he's being held on $1 million bail at the county jail. my colleague, robert honda, will have more at 5:00. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> all right. thank you, janine. a teenager is recovering from serious burns after being accidentally set on fire. ktvu's alex savidge is live at the concord b.a.r.t. station where it all happened to tell us about the unusual circumstances surrounding this situation. good afternoon, alex. >> reporter: well, good afternoon. investigators say this boy's

clothes were soaked with gasoline and that's because he had been working on cars earlier on in the day. that's what led up to the bizarre accident. it was around 11:00. b.a.r.t. police say the teen was dropped off at the station. the person giving him a ride lit a cigarette inside the car. that spark ignited flamable vapors in the car and that triggered the fire. the teen jumped out of the car with his clothes on fire and ran to the station agent for help and ripped off his burning clothes. the fire was out by the time officers arrived on the scene. but this boy suffered serious burns to his arms and chest and had to be airlifted to valley medical center in san jose. b.a.r.t. police looking into exactly what happened and the circumstances here but at this point, they believe this simply was an accident and they say the driver of that car, the person who lit that cigarette, in all likelihood won't physical any criminal charges.

we're live in concord, alex savidge, ktvu channel 2 news. >> thank you. in just over an hour, a hearing is scheduled in the case of a 16-year-old boy accused of setting another teenager on fire. richard thomas has been charged with a hate crime for the november attack on sasha fleishman while on board an a.c. transit bus in oakland. he was wearing a skirt at the time of the attack and suffered second and third degree burns when thomas allegedly set it on fire. currently he's being charged as an adult. but his attorney argues the case should be moved to juvenile court. we've gotten new information on vemming news out of -- developing news out of southern california on a wildfire we first told you about on the morning news, driven by santa ana winds. the colby fire has grown to more than 1700 acres. 2,000 people have been evacuated. two homes have been destroyed. one person burned. this started around 6:00 a.m. and is burning toward a

wilderness area, 25 miles northeast ofian town los angeles in the area of glendora. glendora police chief has just said three people have been booked into jail for recklessly starting the fire. mark tamayo is here with some of the conditions firefighters in southern california are facing and the high temperatures we're also expecting to see here in the bay area. >> hi there, tori. they do have red flag warnings in place right now in southern california with temperatures on track to reach, once again, the mid- to upper, possibly, 80s and very dry. as a result, they have the red flag warning in place until 6:00 this evening. fire conditions running high to the south and even out towards the sierra. they have a red flag warning in place until 9:00 tomorrow morning. we're talking about winter storm warnings here. very unusual for mid-january. current temperatures beginning to warm up already. 69 degrees in san jose.

oakland downtown, checking in at 60. napa, 61. we have some more 70s and possibly some more records to talk about later on today coming up in ten minutes we'll talk about the possible records and the few weekend changes. we'll highlight the coolest day. that's coming up in ten minutes. a two-alarm fire damaged a home in concord. it started at 10:30 at this house on deerfield neighbor. a neighbor shot this video as smoke billowed from the home. a couple, their 1-year-old son and roommate all made it out safely after a neighbor baked on the -- banged on the door and alerted them. fire investigators are looking for the cause. dry conditions here are bringing governor brown closer to making an official trout declaration. it may come as early as tomorrow. in marin county, officials are taking emergency action today by dipping into its water reserve. that's not happened in 20

years. over the next 040 day, the marin water district will be pumping water from phoenix leak to a treatment plan. if we don't get any rain this week, marin county residents can expect rationing and water fines. some people said they are willing to do their part. >> i think it's a good idea. i think we use too much water. i think we should ration water where we can. >> it's been obvious we haven't had enough rain. we'll have to have restrictions and so it's something that should be started as soon as possible. >> the water district says the reason for pumping the phoenix lake reserve now is they want to use the water supply before it begins to evaluate. >> it's been a few days since a naked man was last seen on a school campus in south san francisco. parents and students are still on edge. there have been about a half- dozen reports of a naked man on or near school campuses around the city.

the most recent was monday at south city high. a naked man in his 40s went into a locker room and exposed himself to five girls. angry parents say there were two other disturbing incidents on campus just this month. they are expected to go before the school board tonight to demand more security cameras and police patrols on cameras. >> our children need to be protected and to find out that a naked person came on campus exposing himself is unacceptable to me. >> the school board meeting is set for 7:00 tonight. anyone with information about the naked man is asked to call south san francisco police. petaluma homeowners are being warned about a wave of break-ins. police say they have see sponded to -- responded to seven burglaries this month, including four this week. one woman came home to find her bedroom ransacked with jewelry and family heirlooms stolen. >> the slider thing was popped out. emotionally, edgy, like i think

about what makes me sad about it. i can get to tears. >> police patrols have increased and neighbors are urged to watch for anything suspicious. investigators say they believe the suspects are two mend and a woman. police are using surveillance video to try to determine the suspect's license and they have fingerprints from one burglarized home. sushi chefs and bartenders upset about a new california law. we'll tell you why. more signs that playoff fever is taking hold of san francisco as the 9er faithful gear up for this weekend's nfc championship game. the new merchandise stands that have popped up overnight. [uncle]yeah? ktvu has obtained a copy shot by firefighter's helmet camera minutes after the asiana flight last summer. >> there is a body right there, right in front of you. >> the video shows one of the first responders knew where the 16-year-old girl was before she was covered with firefighting foam. a retired fire investigator says the language used is a clue crews may have thought she was already dead. you don't call a victim

that's alive a body. first thing we do when we get there is we move the people that can walk away from the scene, the walking wounded. they get moved away from the area so you can start to narrow down and triage what you have left. >> the video could be used to support her family's claim that fire crews were negligent because they never stopped to check and see if she was still alive. oakland police are looking for a suspect in connection with the city's third homicide of the year. investigators say a man was shot and killed just after midnight near 14th avenue and east 21st street. that's in east oakland. the man's identity has not yet been released. no arrests have been made. police have not released any information about the suspect or motive for the shooting. oakland's first homicide victim of 2014 was laid to rest today. 13-year-old lee weathersby iii was shot on new year's eve while walking home from the boys and girls club.

he died at the hospital the next morning. two gunmen were scene driving away from the shooting. no arrests have been made. police believe his death may have been a case of mistaken identity. there are now at least 20 flu-related deaths in the bay area this season. this map shows the county-by- county breakdown. as you can now see, there have been flu-related deaths in all nine bay area counties. most recent in sonoma county a 61-year-old woman with underlying health issues died from the flu. napa county's only victim was an 84-year-old man with multiple medical issues and the second victim was a 48-year-old man. some restaurant owners are complaining about a new food safety law in california that requires food handlers to wear plastic gloves. the law goes into effect over the next six months. the owner of one sushi restaurant calls it unfair and a threat to his livelihood since most sushi chefs make

sushi bare handed. under the new law they would be forced to wear gloves or use utensils. >> impossible to do -- wear our gloves during the making of sushi. >> the new law would affect bartenders. some restaurants say the state never notified them about the new law. and they say their workers will not wear gloves until they receive official word from the state it's mandatory. tonight in la fayette, a new round in the battle over a cell phone tower. at&t wants to install a 16-foot tower on the roof of the elementary school on hamlin road. this evening, parents worried about the possible health risks from the towers will hold another meeting with representatives from at&t. an expert on radiation will speak at tonight's meeting. the 49ers ears quest for six as we get closer to the championship game.

the 9er faithful are gearing up. sal castanedo talked to fans and has more signs of excitement popping up. >> reporter: it's like the quest for more gear, here in the mission, sunset, downtown. all sort of popup stands are making overnight appearances. even before noon, this stand was getting pretty good foot traffic. many want more gear before this sunday's game between the 49ers and the seahawks. caps, t-shirts, jerseys, 49er fans can't get enough approaching this sunday's big game. >> tomorrow is 49ers sports day and soap i'm getting some gear for them to wear to school tomorrow. >> reporter: how about some for yourself? and probably for myself. we have to watch the game on sunday. >> i turned around. i passed by. i saw it. i said i gotta get back there. i'm on my way to work. i don't care. >> reporter: this is the third trip for san francisco to the

tonight to rick off our road to the championship coverage. we'll have a half-hour special tomorrow night at 6:30 and then an hour-long special at 9:00 on saturday night. then on sunday, just keep it here on ktvu for the actual nfc game itself. kickoff is at 3:30. stay with us immediately after the game for our "point after" show. now, the weather should be okay up in seattle as well with mostly cloudy skies. the slight chance of a shower. temperatures will be in the mid- 40s. here in the bay area, we have this -- a lot of sunshine, temperatures day three of record warmth out there. here's our live camera. in the south bay for san jose, already temperatures will be already in the lower 60s on track to reach the 70s. right now on live stormtracker2, the storm track, a distant visitor. the entire state in the clear, typically, at least talking about at this time of year, some rainfall toward eureka, cape mendocino but they are in the clear as well with the dry

conditions. as far as current temperatures, san jose right now, 65 degrees. livermore, 68. santa rosa one of the cooler spots at 59 and san francisco downtown already in the upper 60s. as far as records to beat i think there will be a few, especially for downtown san francisco possibly sfo forecasting 71 degrees. oakland downtown and san jose could be just shy but mountain view could be breaking a record as well with a forecast high of 72 degrees. for today, we do have this -- a lot of sunshine. it's warm out there. tomorrow, basically the same deal and then this weekend, a bit of a dooling trend but no -- cooling trend but no weekend clouds. a few clouds by the weekend. but probably partly cloudy skies at most. here's the overall weather pattern -- we have the clear skies over a good portion of the west. we'll expand the maps and show you the activity. looking out toward hawaii, this is where we look for storm development. there is a storm out here. you can see the storm track is drifting way up to our north. as a result, talking about the dry january and still a dry

weather forecast. we can probably extend this for the rest of the month as well with no more raindrops in the forecast. things could change. right now there's not much hope out there. the dry stretch continues. temperatures come down a little bit for both saturday and into sunday. forecast highs this afternoon, approaching the levels from yesterday afternoon. still the warm weather pattern sticks around and possibly records as well. there's that 72 in san francisco. a lot of upper 60s to lower 70s. once again, the coast is clear and temperatures on track to reach the lower 70s. half moon bay, in fact, 76 degrees. san jose, 72. santa cruz yesterday in the lower 80s. today we'll go with 80 degrees. here's a look ahead to your five-day forecast with your weekend always in view. as we aproech the -- approach the weekend, these are some tweaks. partly cloudy skies and same deal for monday. take a look at the updated forecast models. always there's a hope to see a change out there, at least for now, not seeing it.

retailers and railroad taking some of the biggest hits on wall street. investors reacting to a poor outlook from csx and best buy, its stock down 28%. the dow down, 77. the nasdaq is up slightly. s&p down 4. yahoo! has reportedly fired decastro. marissa mayor brought in decastro but results have been disappointing. decastro is said to have received $64 million to come to yahoo! and will collect another 46 million as he exits. the san francisco giants have spent years trying to convince pablo sandoval to get

into shape. this season, fans will see a much slimmer panda. he showed this photo online. he reportedly lost 42 pounds this offseason. he weared more than 280 pounds at one point last year. team sources say he started slipping down during the summer after hiring his brother as a full-time chef. oscar nominations are out. >> i'm pleased to announce that the film selected as the best picture nominees for 2013 are -- >> "american hustle" and "gravity" earned ten nominations for best pictures. big names that did not get a nod this year include tom hanks, emma thompson, oprah winfrey and robert redford.
